The Big News: The ADU Act of 2025
In 2025, the Maryland General Assembly passed HB 1466 — the Accessory Dwelling Units Act of 2025. This codifies a statewide policy that promotes and encourages ADU development on single-family residential properties. The state policy took effect on October 1, 2025. By October 1, 2026, local governments in charter counties and Baltimore City must adopt laws authorizing ADU development.
What does this mean for tiny homes? If your tiny home qualifies as an ADU (which many do, especially on a foundation), Maryland is actively creating a legal pathway for it across the state. Like other state programs that incentivize ADU construction, Maryland's approach is tied to affordability goals.
County-by-County Reality
Right now, Maryland's tiny home rules are still largely determined at the county level. Montgomery County allows tiny homes as permanent residences under residential zoning. Baltimore County permits THOWs in designated areas. Garrett County is one of the most flexible — fewer restrictions, good for off-grid tiny living. Frederick County has been open to innovative housing and recently updated zoning to allow certain ADUs under 800 sq ft.
On the other hand, some counties like Anne Arundel explicitly classify THOWs as recreational vehicles, which limits full-time living options.
Maryland requires a minimum of 320 sq ft for a new residence in some jurisdictions, with usable rooms at 120 sq ft minimum.
THOWs vs. Foundation in Maryland
THOWs are generally treated as RVs in Maryland, which restricts full-time living in most areas outside of RV parks. Foundation-based tiny homes have a much smoother path — especially as the ADU Act takes effect.
